McNEILLY ORDER This 12th day of November, 1985, Upon due consideration of the briefs of the parties in this appeal, it appears to the Court that: (1) Zane Glazer, the victim in this case, was born on April 8, 1984. Before he was a month old, he suffered two broken legs and a broken arm. Defendant, who frequently questioned his paternity of the child, was charged with and convicted of Assault Second Degree. At trial, the defendant's wife testified that the defendant had told her that he wanted to see how far he could bend Zane's legs back, and that he had hurt him. The defendant said he had no recollection of making these statements and contended the child's injuries were caused accidentally. An expert witness, Carol Kerrigan, R.N., testified for the State, and the Court admitted into evidence her notes assessing the child's injuries as resulting from probable child abuse. Defendant now appeals his conviction on four grounds.
